All sales made by Tarte de Fleurs are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your statutory rights as a consumer. By ordering from Tarte de Fleurs you agree to be legally bound by these Terms and Conditions and accept that they may be modified or amended and posted on this website from time to time. Wedding Consultations
Consultations are by appointment only. Appointments can be made by visiting our contact page and filling out the online form.
Appointments last for one hour and are for a maximum of two people and three flavours. You can also call us if you need to discuss any aspects of your cake before making a booking.
Bookings can also be made over the phone or by email without prior consultation.
Deposits
All wedding cake orders require a non-refundable deposit of 30% of the total cost to book the date but not less than £100, or if you have yet to decide on your design a flat rate of £150.
All other orders require a non-refundable deposit of 50% but not less than £40.
For cakes with less than 3 weeks notice the full cost of the cake must be paid at time of booking.
Please note that all deposits are non-refundable and non-transferable.
All deposits become due when the order has been placed and details checked and agreed by you. All orders are deemed to have been accepted only when the deposit has been paid.
Final Payments
For wedding cakes the remaining balance is due 2 weeks before the event. For all other orders the balance must be cleared 1 day prior to the collection/delivery day.
Non-Payments
In the event that any payment is subsequently declined, the order will not be completed or released until alternative funding arrangements have been agreed and payment is made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed.
The Company accepts no responsibility for any loss howsoever caused or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.
Collection
Your order may be collected at a pre-arranged time. Cakes that are collected by the customer are always boxed for transportation. We provide full instruction on the care and handling of your cake. We do not take any responsibility for any damage that may occur to the cake once it has left our shop.
Delivery
If requested we will deliver you cake to your venue at a pre-arranged time. If you have a specific delivery date and require delivery before a given time, please specify this when placing your order.
Delivery into Central London will incur an additional £25 charge if needed. All other delivery charges will be provided on request. For the Harlow and Epping areas the deliveries are at no extra cost. All deliveries are made between 4pm-6:30pm.
It is the customer’s responsibility to give us the correct delivery information, and that someone is available to receive it. If the recipient is not available to receive the cake, the order will be returned to the company who will contact you to arrange an alternative delivery time for which an additional charge will be payable by the customer. The company accepts no responsibility for any loss or consequential loss incurred by the customer as a result.
On occasion we are faced with severe weather conditions, public unrest, or other unexpected events that may make your venue inaccessible. You can be assured that we will always do our best to deliver as pre-arranged.
Set up
It is customer’s responsibility to provide the company with the set-up details and arrangements made with the venue for the location and display of your cake. The company cannot be held responsible for the location of the cake at the venue. Please ensure, therefore, that the display location is level, stable and strong enough to hold the cake..
Publication and promotional rights
The customer agrees that the company is the sole designer and owner of the final cake design. All rights in any original designs created and designed by us shall remain the exclusive property of Tarte de Fleurs. From time to time our designs are published in the media e.g. wedding magazines. We reserve the right to use any image of a customer’s cake made by the company for publication after the event date unless previously agreed in writing between the customer and the company.
We cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar.
Cancellations/Refunds
Wedding cake/special order cancellations:
Deposits are non-refundable and non-transferable under any circumstances due to any loss of business arising from turning away other bookings on that date. Full payments made less than 2 weeks in advance of the delivery date are non-refundable.
As your wedding cake and/or special order booking is reserved solely for you and certain components for your cake/s may be ordered months in advance, the following conditions are implemented when an order is cancelled:
More than 3 weeks from delivery date – 50% of the total cost will be payable
0 to 2 weeks from delivery date – 100% of the total cost will be payable
Wedding cake/special order cancellations must be made by email.
Flowers and in-edible items
At the request of the client, cakes sometimes contain in-edible items such as broaches, ribbons, flowers and feathers etc. These items must be removed before serving and we accept no responsibility for any harm these might cause. Any contamination to your cake is not our responsibility.
Dietary Requirements/ Allergies
We are happy to offer suggestions on cakes that are ‘free from’.
Eggs, nuts, alcohol and wheat are all common requests. Please be aware that whilst your chosen cake may not be made with nuts, a nut product or wheat, it will be prepared in a kitchen where nuts and wheat flour are frequently used. Allergy information is provided with all cake orders.
We cannot be held responsible for any ingredient contaminated at source, or any harm that may occur. If you are unsure, please ask.
COMPLAINTS
If you wish to make a complaint to us or let us know any concerns after receiving the Goods, please do so in writing. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.
IMPORTANT: The General Data Protection Regulation (GDPR) will apply in the UK from 25 May 2018. It will replace the 1998 Data Protection Act and introduce new rules on privacy notices, as well as processing and safeguarding personal data. We will be updating this privacy policy document ahead of 25 May to reflect the new rules.
